Acceptance of Agreement

Rionet Media Systems (referred to as "us" or "we") provides the iAirControl application for iOS devices subject to compliance with all the terms, conditions, and notices contained or references herein (the "Terms Of Use").  We reserve the right to change the Terms Of Use without notice.  Agreeing to the Terms Of Use includes understanding that the application user is responsible for reviewing the Terms Of Use for any changes or modifications.

Use of Software

Rionet Media Systems is not responsible for any issue or damage to user equipment.  The iAirControl application is provided as-is.  All efforts are made to ensure software integrity.  Adequate testing is done prior to software release.  Any and all external equipment used in association with the iAirControl application is the responsibility of the user.  Rionet Media Systems is not responsible for insecurities or exposures of these systems that may cause harm up to and including any damages caused through the noted exposure or insecurity. All user data entered into the iAirControl application is subject to collection by Rionet Media Systems for purposes outlined in the iAirControl Privacy Policy.  Any and all usage data obtained by the iAirControl application from external systems is subject to the terms of the iAirControl Privacy Policy.  Rionet Media Systems ensures the security of information collected and stored within the iAirControl application.

Disclaimer of Warranties and Limitation of Liability

The iAirControl application and all content are provided on an "as-is" and "as-available" basis without warranty of any kind, either expressed or implied, including without limitation, warranties of merchantability, fitness for a particular purpose, accuracy, completeness, currentness, freedom from interruption, viruses or other defect, and non-infringement. Your sole remedy against us for dissatisfaction with the iAirControl application or any of its contained content is to stop using the application and its content.  In no event shall we or our officers, directors, employees, agents, licensors or content providers (referred to as "our affiliates") be liable for any damages, including, without limitation, indirect, consequential, special, incidental or punitive damages, resulting from the use or inability to use the iAirControl application or its content, whether based on warranty, contract, tort, or any other legal theory, and whether or not we or our affiliates are advised on the possibility of such damages.

Privacy

Our Privacy Policy applies to the use of the iAirControl application and its terms are made a part of the Terms Of Use by this references.

User Submissions

Users making a submission to Rionet Media Systems agree that communications will not contain content that: (i) is defamatory, indecent, harassing or otherwise objectionable; (ii) infringes or violates any rights of any party; or (iii) contains a virus or corrupted data. All email and other correspondence that users submit shall become the sole and exclusive property of Rionet Media Systems. Submissions of any business information, ideas, concepts or invention shall be considered: (i) non-confidential; and (ii) the sole and exclusive property of Rionet Media Systems.  Rionet Media Systems will have no obligation of any kind with respect to submissions and are free to use submitted information as desired.

Governing Law, International Use

The Terms Of Use will be governed by and construed in accordance with the internal laws of the Province of Manitoba, without regard to its conflicts of law provisions.  Users agree to the personal jurisdiction by and venue in the provincial and federal courts of Manitoba, Canada, and waive any objection to such jurisdiction or venue. Although the iAirControl application may be accessible worldwide, Rionet Media Systems makes no representation that materials in the application are appropriate or available for use in locations outside Canada and the United States, and accessing the application from territories where its use is illegal and prohibited.

Entire Agreement

The Terms Of Use represents the entire agreement between the user and Rionet Media Systems with regard to the subject matter addressed herein and supersedes all prior to contemptoraneous agreements or understandings, writeen or oral.  The Terms Of Use shall be binding upon and inure to the benefit of the parties hereto and their respective successors and lawful assigns.

Waiver

Any failure by Rionet Media Systems to enforce or exercise any provisions of the Terms Of Use shall not constitute a waiver of that right or provision.  The failure to act with respect to a break by users or others does not waive our rights to act with respect to subsequent or similar breaches.
